The Michigan Vehicle Code, Section 257.319(8) authorizes the Secretary of State to assess a $25 penalty on any individual who renews his or her Michigan driver's license more than 60 days past the expiration date. Michigan Vehicle Code, Section 257.319(8) states that any individual who renews his or her Michigan driver's license more than 60 days past the expiration date would be assessed a $25 penalty fee by the Secretary of State. The code section goes on to state that this fee is in addition to the $28 renewal fee for each license plate and reinstatement fees for each unpaid suspension or revocation under chapter IV of subtitle II of Title IX. The penalty is not charged when the renewal of the license is done within 60 days of the expiration date. However, it can be imposed when an individual's Michigan driver's license was expired for more than 60 days at the time of renewal. For example, if an individual in Michigan has an expired driver's license in December 2005 but does not renew his or her driver's license until March 2007, he or she will be assessed a $25 penalty fee in addition to the standard $28 renewal fee for each plate and reinstatement fees for any unpaid suspensions or revocations under chapter IV of subtitle II of Title IX. The penalty fee covered by Section 257. 319(8) was established in Section 257.319 of the Michigan Vehicle Code in 1979 and has been updated several times since. In 1984, the penalty fee was increased from $5 to $7. In 2001, it was changed from being a separate charge to the renewal fee for the state driver's license. In 2011, it became a charge separate from but additional to any other overdue fees or penalties assessed on a Michigan driver's license. In 2015, Governor Rick Snyder signed Senate Bill 526 into law amending Section 257.319(8) of the Michigan Vehicle Code which added a Penalty Fee of $25 on any individual who renews their driver's license more than 60 days past the expiration date. The new Section 257.319(8) went into effect January 1, 2016. In 2017, Governor Rick Snyder vetoed Senate Bill 685 which would have removed the penalty fee from Section 257. 319(8). On November 21, 2017, the Michigan House passed a bill that would have kicked the decision over whether to remove the Penalty Fee in charge to a citizen's initiative called "The Drive to Vote." On November 27, 2017 in a 74-9 vote in the Michigan Senate, Senate Bill 685 was signed into law removing the Penalty Fee from Michigan statute by passing SB 685 with no votes against it. The penalty fee for renewing a driver's license late was $25.
